Johnny Sutton, “Testify or resign!”

Yesterday, the House approved a move by Rep. Tom Tancredo and
other conservative Republicans to attempt to free Border Agents
Ramos and Compean by blocking the Bureau of Prisons from
keeping them in federal prison.

As we explained in an earlier update, the move came about as
House lawmakers debated a bill funding the Justice Department
for the coming year. The agents would be freed because the
Bureau of prisons would be prevented from spending any money
to incarcerate them.

“What this does is release these two individuals while the
appeal goes on,” said Rep. Ted Poe, a retired Texas judge,
who has also been a lightning rod in this case.

The move, however, isn’t set since it could be dropped from the
bill during House-Senate negotiations in the fall.

Next week, the House Foreign Affairs Committee will
be holding hearings focusing on the Mexican consulates role
in the prosecution of Ramos and Compean.

Sutton, the federal prosecutor for West Texas, was asked to
testify, and refused. His refusal angered a number of lawmakers–
including Rep. Dana Rohrabacher who issued a press release stating
that the prosecutor should “either testify under oath before
Congress and explain these things or resign as U.S. Attorney.”

In question are Customs and Border Protection documents about
multiple, unsupervised border crossings by Osbaldo Aldrete Davila,
the drug smuggler who was shot by Ramos after he refused to stop.

“These documents verify [he] had an unconditional, unescorted
access to pass into the U.S. Free access passes were issued to
him even after he was identified by the DEA in a second shipment
of narcotics into our country.”

I cannot say this enough. The fervor that is now
taking place in Washington over Ramos and Compean is a direct
result of unrelenting grassroots pressure on lawmakers demanding
these men be freed.

With the House hearings scheduled to begin next week, I want
to turn up the heat even more in the coming days with phone
calls and faxes to key leaders–including the President!
